§ 11-14. Junk automobile bodies, etc.; notice to remove; removal by city; penalty for section violation; exceptions; term defined.

  • (a)

    Junk automobile bodies, etc. No firm, person or corporation in the city shall place or keep materials or objects, junk automobile bodies, rubbish, refuse, weeds, grass or garbage (other than in garbage containers) on any lot or lots within the said city which will cause unsanitary or unsightly conditions.

    (c)

    Penalty for violation of section. The violation of this section shall be punishable by a fine not exceeding one hundred dollars ($100.00) or imprisonment for a term not exceeding thirty (30) days, with each day of said violation constituting a separate offense. In addition to the above penalty, any conditions caused or permitted to exist in violation of this section shall be deemed a public nuisance and may be enjoyed by the city as provided by law for other nuisances.

    (d)

    Exceptions. This section shall not be applicable to licensed operators of junkyards or dealers in scrap materials as those terms are ordinarily defined.

    (e)

    Definition. The term "junk" means any property (except land) that: (a) is not able to be used in the manner or the purposes for which it was designed or constructed, or (b) is inoperative, or (c) is in a state of disrepair, or (d) scrap metal, or (e) is discarded, or (f) is no longer useful in its original form, or (g) old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris, waste, or dismantled or wrecked motor vehicles, or parts thereof, iron, steel, and other old or scrap metals, or (h) a motor vehicle (including, but not limited to cars, trucks, four wheelers, three wheelers and motorcycles) that is incapable of being moved under its own power or rendered inoperative by reason of a lack of any essential parts such as wheels, tires, motor, radiator, or other essential components.
